General Terms of Sale

1. Object

1.1 The Online Shop Garrafeira Tourinto Ltd, has its headquarters at Rua Miguel Bombarda nº7c 1º, 2830-354 Barreiro, under the single registration and VAT number 516 989 952, with a share capital of 5000 € (euros), hereinafter Garrafeira Tourinto.

1.2 These General Terms, together with the order form and other elements referred to in them, are intended to regulate the terms and conditions that will govern the provision of the Online Shop Service of Garrafeira Tourinto Lda.

1.3 The purchase of any and all products in the Online Shop of Garrafeira Tourinto, implies acceptance of these General Terms of Sale Online.

1.4 Any and all alcoholic beverages available for sale in the Garrafeira Tourinto online shop can only be purchased by persons of legal age in their country of residence.5.1 Para o envio de encomendas, solicita-se a escolha de Portugal Continental ou Espanha Continental.

2. Product Information, Prices and Contents

2.1 Garrafeira Tourinto reserves the right to change, at any time and without prior notice, the information and/or the commercial offer presented about: products, prices, promotions, packs, commercial conditions and services.

2.2 There may be differences between the images, description and information relating to each product at Garrafeira Tourinto and the product subsequently delivered, particularly with regard to the year in which the products were harvested. All products are subject to stock shortages.

2.3 Alcoholic drinks and olive oils are subject to constant changes over time, of which the consumer should always be informed. Garrafeira Tourinto is not responsible for any modifications or discrepancies between the information available on our website, provided by the producer or distributor, and the information on the bottle labels. We advise you to always read the information on the labels before consumption. Most wines contain sulphites and sulphur dioxide.

2.4 Although Garrafeira Tourinto makes every effort, some of the products may have an inaccurate price, which is why Garrafeira Tourinto verifies prices when processing orders.

2.5 The prices shown in Garrafeira Tourinto are merely indicative and do not constitute a contractual offer. Any difference between the actual price of the product and the advertised price will be corrected as soon as it is detected. In the event that the actual price is lower than the advertised price, Garrafeira Tourinto will refund the difference. In the event that the actual price is higher than the advertised price, the customer will be informed by email by Garrafeira Tourinto, and may accept the decision or cancel the order, for a maximum period of 15 days after the sending of that email.

2.6 If you intend to order a large number of bottles of the same reference, you should contact Garrafeira Tourinto by email (info@tourinto.pt) or phone prior to placing the order, so that we can confirm the existence of the desired quantity in stock.

2.7 Under Portuguese law, all prices shown at Garrafeira Tourinto include the respective VAT rates in force in Portugal, unless otherwise stated.

2.8 If you select a country of dispatch outside the European Community, the prices of the products may appear without the respective VAT rates in force in Portugal, since they will be charged in the country of destination.

2.9 The discount policy defined by Garrafeira Tourinto is temporary and may be changed, suspended, or terminated without prior notice.

  • Discounts for order amounts apply as follows: €150 – 2.5%, €400 – 5%, €800 – 7% and €1750 – 9%.
  • Discounts for order amount brackets apply to products exempt from VAT or any other tax, and do not apply to shipping costs or any associated fees.
  • Discounts are granted either by order amount brackets or for one or more specific products, as well as seasonal discount campaigns, which cannot be combined with each other.
  • In the event of a discount campaign for one or more specific products, this shall take precedence over the discount for order amount ranges, and the two cannot be combined.
  • In the event that the discount is calculated differently from what was advertised, this is due to a computer error, and Garrafeira Tourinto reserves the right to correct the discount in accordance with what was advertised and specified in the Terms and Conditions of Sale.

3. Order and Payment

3.1 The orders placed at Garrafeira Tourinto, are divided into 3 processing stages: 1 - Pending - awaiting payment by the customer; 2 - In Process - payment has been made, but not yet shipped; 3 - Finished - the order has been shipped to the customer's address.

3.2 When you place an order at Garrafeira Tourinto, you will receive an e-mail after confirming and validating your purchase. The email will be sent to the contact address provided when the customer registered their account, with full details of delivery, billing, payment information, products and values.

3.3 Garrafeira Tourinto suggests to all customers, that they always confirm the information before completing the purchase, in order to avoid not receiving the email. If the customer does not receive the order confirmation email, they are requested to contact Garrafeira Tourinto through the contacts available on the website (www.tourinto.pt), indicating the email address again, so that a new notification can be sent.

3.4 If you wish to change any information, due to an error in the details provided by the customer, please contact us through the contacts available on the website (www.tourinto.pt) as soon as possible, and this can only be done if the order has not yet been dispatched.

3.5 Any and all changes to details of orders already dispatched will be evaluated by Garrafeira Tourinto in conjunction with the customer, in order to find the best possible solution for delivery. In some cases they may be subject to additional charges that will have to be borne by the customer.

3.6 All orders at Garrafeira Tourinto will only be processed after the effective receipt of payment, being that the formalisation of the order, by itself does not constitute a reservation of the products.

3.7 All orders placed with Garrafeira Tourinto for which payment has not been made will be automatically canceled after 12 hours, as no product can be reserved without the respective payment having been made.

3.8 The cancellation of an order must be expressly requested by the customer before dispatch through the contacts available on the website (www.tourinto.pt).

3.9 If an order cannot be met in part or in full, the customer will be immediately contacted by Garrafeira Tourinto in order to find the most appropriate solution.

3.10 Payments in the Online Shop of Garrafeira Tourinto are accepted exclusively in Euros (€) through Bank Transfer, for customers with a bank account in the country for which Garrafeira Tourinto carries out shipping, and may eventually be requested proof of payment. Payment can also be made by MB, VISA or Mastercard, and payment by MBWAY is also accepted (service only available in Portugal).

3.11 Garrafeira Tourinto sells its products to the continental region of the following countries: Portugal, Germany, Angola, Austria, Belgium, Brazil, Bulgaria, Canada (Except: New Brunswick, Newfoundland, Northwest Territories, Nova Scotia, Nunavut, Prince Edward Island, Saskatchewan and Yukon and for Private Customers only), South Korea, Croatia, United Arab Emirates, United States of America, Slovakia, Slovenia, Spain, Estonia, France, Greece, Ireland, Japan, Italy, Hungary, Latvia, Lithuania, Luxembourg, Monaco, Macau, Netherlands, Poland, United Kingdom, Czech Republic, Romania and Switzerland. However, shipping to some of these countries may be temporarily unavailable, and you should check their availability on Checkout, when you select the destination country.

3.12 You can place your order for Madeira and the Azores directly at our Garrafeira. However, for other islands you should contact Garrafeira Tourinto before placing the order to check its feasibility and costs.

3.12 For orders placed for countries outside the European Union, the delivery and billing address must be the same. When selecting the address and country of destination of the order, you must verify that the prices appear without the VAT rate. If this does not occur, you should contact Garrafeira Tourinto through the contacts available on the website (www.tourinto.pt), before making the payment.

3.14 The payment of orders destined for countries outside the European Union, can only occur without the application of the VAT rate in case they are shipped jointly by Garrafeira Tourinto and the transport company selected by Garrafeira Tourinto, which will carry out the transport to the country of destination.

3.15 Orders that fall under points 3.12 and 3.13 (made to countries that are not part of the European Union), may incur customs fees and costs decreed by the country to which the order was sent, and the payment of these is the responsibility of the customer.

4. Shipping costs

4.1 Whenever you place an order, the respective shipping costs and eventual transport fees will be added, which vary depending on the value of the order, the size of the order, its weight and the destination country to which it will be sent, and its cost may be different within the same country. Changes may also occur depending on variations in the costs of transport services.

4.2 The shipping costs and other applicable taxes related to the order are visible before the order is finalised. If you do not accept payment for these, you must cancel your order.

4.3 There may be a total value of the order from which the shipping costs are assured by Garrafeira Tourinto, however this can be modified, being the customer informed before finalising the order.

4.4 Orders for bottles with volume greater than 750 ml to any destination outside Portugal may be subject to changes in shipping costs, so you can be informed of these changes before the order is dispatched. Failure to accept the shipping costs will result in the cancellation of the order and a refund of the amount paid by the customer.

4.5 Orders shipped to outside the European Union, although shipping costs and any taxes are paid at the time of purchase, may be subject to taxes and customs duties in the destination country, which are the customer's sole responsibility.

4.6 Garrafeira Tourinto reserves the right to alter the transport costs and respective taxes of orders already placed, the customer being informed before the order is dispatched, and the amount previously paid by the customer will be refunded if the alteration is not accepted.

5. Shipping and deliveries

5.1 When sending orders, we ask you to choose the country of dispatch.

5.2 Orders can and should be tracked via the link provided in the email notification. If the customer does not receive this email, they should contact Garrafeira Tourinto using the contact details provided on the website (www.tourinto.pt) so that a new notification can be sent.

5.3 For shipping to the Azores and Madeira it is mandatory that the shipping address is the same as the customer's, as well as that you must always provide your tax identification number.

5.4 Shipments to islands or autonomous regions of other countries may be subject to additional charges, so you should contact Garrafeira Tourinto.

5.5 Shipping to countries outside the European Community may be subject to taxes and customs duties in the country of destination, the payment of which is the responsibility of the consignee.

5.6 The shipping service provided by Garrafeira Tourinto to the United States of America, when available, includes postage and customs duties, with the customer receiving the order directly at their home, unless otherwise indicated. This service may not be available in some states, as well as being subject to extra charges borne by the customer, as in the case of Alaska, Hawaii and Puerto Rico, so the customer should contact Garrafeira Tourinto through the contacts provided (www.tourinto.pt)before making the payment.

5.7 The transport service to Brazil and Angola, although generally successful, is not covered by any type of insurance, as well as that Garrafeira Tourinto does not assume the eventual risks of loss of the order or breakage of the bottles, and you should consider these before placing your order.

5.8 Orders placed by Garrafeira Tourinto are dispatched by specialised companies with a variable delivery period, which generally averages 24 to 72 hours (1 to 3 working days) for Portugal mainland and Spain mainland, 3 to 5 working days for the other European Union and Switzerland countries (see point 3.11), 5 to 10 working days for the United Kingdom, Angola, Canada, South Korea, the United Arab Emirates, Japan and Macau and 20 to 30 working days for the United States of America and Brazil. However, it should be noted that possible delays in deliveries may be due to reasons beyond the control of Garrafeira Tourinto and, in such cases, it is not possible to guarantee exact delivery times.

5.9 All shipments outside the European Union imply that the customer's Tax Identification Number is indicated, as well as that the shipping address is the same as that of the customer. In addition, additional documents may be requested as required by the competent authorities.

5.10 As a rule, deliveries are made during business hours on working days, to the delivery address indicated by the customer when placing the order.

5.11 If the order is not delivered within the period of days indicated in paragraph 5.4, the customer should contact Garrafeira Tourinto through the contacts available on the website (www.tourinto.pt), in order to solve the problem.

5.12 All products shipped by Garrafeira Tourinto must be carefully checked upon delivery. If the customer finds that the order is damaged, they should not accept delivery from the carrier. Additionally, if the products you ordered are not in the package, you should immediately notify Garrafeira Tourinto using the contact details provided on the website (www.tourinto.pt), indicating the order number or the number of the document that accompanied the order, attaching images of the package as you received it. If you do not check the order after delivery or collection at the Service Point, the order will be considered satisfactory and complete, and no subsequent complaints will be accepted.

5.13 Garrafeira Tourinto is not responsible for shipments made to countries where the respective law does not allow the entry of alcoholic beverages, as well as it is the customer's responsibility to pay any and all customs duties.

5.14 In the event of an unsuccessful delivery attempt by the carrier due to the customer's absence, the carrier will forward the order to a collection point for the customer to pick up, of which the customer will be notified. If the customer does not pick up the order within the specified period, it will be returned, and the customer will be responsible for new delivery costs. If the customer does not wish to collect the order from the collection point and wishes to be reimbursed, Garrafeira Tourinto will only reimburse the value of the items, with the transport costs being borne by the customer.

5.15 If the address provided for delivery is incorrect or incomplete, preventing the carrier from delivering the order, it may be returned to the sender. The costs of a new shipment will have to be borne by the customer, and if you wish to cancel the order, the shipping costs will not be refunded.

5.16 If for any reason the customer is unable to receive the order or pick it up at the location indicated by the carrier, the customer is requested to contact Garrafeira Tourinto, through the contacts provided on the website (www.tourinto.pt), so that together we can find the most appropriate solution.

5.17 If the customer is unable to arrange a new delivery with the carrier and/or no contact is made with Garrafeira Tourinto in order to find a solution, the order may be returned by the carrier to Garrafeira Tourinto. In order for a new shipment to be made, the customer will have to bear the costs of the return and reshipment of the same.

5.18 Changing the delivery location of orders already shipped may be subject to extra charges, regardless of the country of destination, which will have to be borne by the customer.

5.19 From June to September (inclusive), all orders placed on a Thursday will only be shipped on the following Monday, in order to safeguard product quality. Exceptionally, if there is a public holiday on Thursday or Friday, orders will also only be dispatched on the following Monday.

5.20 Garrafeira Tourinto does not guarantee the delivery of wines with their respective boxes of origin, and the dispatch of boxes of origin must be requested, subject to availability and the addition of shipping costs.

5.21 Orders requested for delivery to a hotel or holiday accommodation will only be delivered when the guest is present, and early deliveries are not possible as the tables may not be received.

5.22 All orders placed by citizens residing in countries outside the European Union who wish to have their orders delivered to a country within the European Union, such as hotels, will be invoiced with VAT and associated shipping costs.

6. Applicable Law

6.1 Garrafeira Tourinto recognises all its customers' right to terminate the contracts they enter into with it, allowing them to return, within 14 (fourteen) days for European Union countries, of products purchased under the terms of Decree-Law No. 143/2001 and Decree-Law 82/2008 of 20/05.

6.2 For exchanges or returns, the customer is requested to contact Garrafeira Tourinto through the contacts available on the website (www.tourinto.pt), taking into account the conditions described below:

1) Indicate the order number or the documents that accompanied the order.

2) In order to be returned, orders must be in perfect condition, with all the elements on the label visible, the capsules or seals on the corks intact, accompanied by their original packaging, document or associated item, where applicable. They must also be accompanied by the respective invoice.

3) Orders must be returned in the original shipping box, sealed in the same way they were sent and received. Returns in other types of packaging or any other type of wrapping will not be accepted.

4) Returns must be requested from Garrafeira Tourinto Lda and carried out by the same carrier that made the delivery or, if necessary, by another carrier to be designated, with the costs borne by the customer. After confirming acceptance of the costs, the return slip will be sent by email, which must be printed and affixed to the outside of the package together with the invoice, inside a transparent, waterproof plastic bag.

5) The costs of returning orders are borne entirely by the customer. The return shipping costs to mainland Portugal are equal to the amount charged by the carrier up to a maximum of €150 (depending on the weight of the order), while for other European Union countries, the cost will be equal to the amount charged by the carrier up to a maximum of €250 (depending on the weight of the order). The customer will be informed in advance of the return cost before the collection of the products to be returned is scheduled, and must confirm by email that they accept these costs, which will be deducted from the amount to be refunded.

6) For countries outside the European Union, Garrafeira Tourinto Lda. does not accept returns of products.

7) Bottles that break during return transport because they were not packaged in the same conditions as when they were sent will be the sole responsibility of the customer, and therefore no refund will be given for them.

8) Incorrect products may be returned, with Garrafeira Tourinto being responsible for shipping and collection costs, provided that the customer reports this circumstance within 14 (fourteen) days from the date of receipt of the product.

9) Once the goods have been received at our premises, we will proceed to refund their value in accordance with the payment method used by the customer, or another solution previously agreed with the customer, deducting the amount incurred by the customer for the return shipping costs.

6.4 Garrafeira Tourinto will not accept the return of the product after it has been used, if it has been altered or modified, or if it does not meet the requirements described in point 6.2 – 1) to 9).

6.5 Garrafeira Tourinto will not be held responsible for deficiencies arising from incorrect use, negligence, bad storage conditions or causes of force majeure.

6.6 Shipping costs and the cost of the products ordered will not be refunded to the customer if the return rules described in point 6 (6.1 to 6.8) of the Terms and Conditions of Sale have not been complied with.

7. Applicable Law

7.1 These general conditions and all disputes arising that are related to these general conditions, including their validity, the use of the website or any purchase therein shall be governed by Portuguese Law, namely Decree Law No. 24/2014 of 14 February, as amended by Law No. 47/2014 of 28/07. 7.2 All purchases made on the Garrafeira Tourinto website are subject to Portuguese law. Any conflict or divergence of interpretation of the General Terms and Conditions of Online Sale will be submitted to the competent Portuguese Court.

7.2 If the Customer is outside Portugal, Garrafeira Tourinto hereby informs that any legal proceedings must be exclusively initiated in the Portuguese Courts.

7.3 Under the terms and for the purposes of the provisions of article 18 of Law no. 144/2015, of 8 September, amended by DL no. 102/2017, of 23/08 it is informed that the available ADR entity is the Lisbon Consumer Conflict Arbitration Centre, with the following contact details:
